For decades, I have documented a systemic failure of accountability at the heart of the British Broadcasting Corporation. Today, that documentation moves to a formal public record of statutory non-compliance.
The issue is a guide and directions published by the BBC’s International Editor, Jeremy Bowen, detailing the tactical use of improvised explosives (petrol bombs). While the BBC has spent around 12 months evading my complaints, the legal landscape in the UK has shifted. As of January 2026, the BBC is now caught in a regulatory deadlock between its own editorial guidelines and the criminal law of the land.
BBC’s Violations
I have today served a Formal Legal Notice to the BBC Executive Complaints Unit, copying in both Ofcom and the DCMS Charter Review Team. This notice outlines three primary categories of violation:
Criminal Law (Explosives & Terrorism): Under R v Bouch, a petrol bomb is a legally defined "explosive substance." Providing a tactical "guide" for its use violates the Explosive Substances Act 1883 and the Terrorism Act 2006, which criminalizes the dissemination of information "likely to be useful" for acts of violence.
The Online Safety Act 2023: In 2026, the BBC’s "news publisher" exemption does not shield it from the dissemination of Priority Illegal Content. This instructional material bypasses journalistic protections and enters the realm of criminal liability.
Editorial "STOP" Commands: The BBC’s own 2026 Guidelines (Section 8.3.1) mandate a "STOP" referral for any content likely to encourage crime. By hosting this guide on a verified corporate handle (@BowenBBC), the BBC has bypassed its own safety valves.
The Two-Tier Disparity
In 2025, we witnessed private citizens prosecuted and imprisoned for online incitement involving far less specific content. Yet, for nearly four years, the publicly-funded broadcaster has hosted a tactical manual for lethal strikes without repercussion. This is the definition of Two-Tier Justice.
The Escalation
The timing of this notice is critical. The 2027 BBC Charter Review is currently in its public consultation phase (the "Britain’s Story: The Next Chapter" Green Paper). I have formally submitted this case as evidence of the BBC’s failure to meet its safety and legal obligations.
